Nghiên cứu này tổng quan kinh nghiệm về sở hữu đất đai ở các nước trên thế giới, phân tích quá trình phát triển, chỉ ra những bất cập và đề xuất hàm ý cho đổi mới chính sách đất đai ở Việt Nam. Bằng việc tổng hợp và phân tích nguồn dữ liệu đã công bố, nghiên cứu chỉ ra rằng: Thế giới đang tồn tại cả phương thức đa sở hữu và đơn sở hữu về đất đai. Đa sở hữu về đất đai, thừa nhận quyền tài sản và thị trường đất đai là phổ biến và ưu việt hơn so với đơn sở hữu đất đai trên các phương diện quản lý, sử dụng và bảo vệ tài nguyên đất, hài hoà các mục tiêu chính trị, kinh tế - xã hội và môi trường. Ở Việt Nam, căn nguyên của các mâu thuẫn phát sinh về đất đai bắt nguồn từ vấn đề sở hữu đất đai và quyền sử dụng đất chưa thật phù hợp để phát triển nền kinh tế theo cơ chế thị trường, định hướng XHCN. Vì vậy, Việt Nam cần sớm công nhận “quyền sử dụng ruộng đất” là quyền tài sản về đất đai, hoàn thiện và sớm công nhận thể chế thị trường đất đai. Về lâu dài, Luật Đất đai cần được sửa đổi theo hướng: thừa nhận phương thức đa sở hữu về đất đai để phát huy tối đa tiềm năng của đất đai, hài hòa các mục tiêu kinh tế, chính trị, xã hội và cân bằng quan hệ giữa Nhà nước, thị trường và người dân về đất đai.

This paper provided a critical review of land ownership experiences f-rom different countries around the world, analyzed chronological development, identified shortcomings and recommended land policy implications for Vietnam. By synthesizing and analyzing diverse secondary data sources, the findings showed that multi-ownership and single-ownership types of land were existing simultaneously in the land tenure systems around the world. Unsurprisingly, the multi-ownership of land tended to be more popular and preeminent than the single ownership manner in terms of management, use and conservation of land resources and harmonization of political, socio-economic, and environmental goals. In Vietnam, the core causes of conflicts related to land initiated f-rom of land ownership and land property rights which are inappropriate to develop a socialist-oriented market economy. Therefore, the study proposed that Vietnam should shortly consider „land use rights‟ as property rights to land and fully adapt and improve a legal mechanism for land market development. In the long term, the Land Law should be renovated by adapting land multi-ownership type to maximizing potential benefits f-rom the land resource and harmonizing politico-socio-economic goals and balancing relations among the state, market, and citizen on land.
