Thai Nguyen has long been known for the special tea of Tan Cuong. The geographic region of Tan Cuong has been the Nation Office of Intellectual Property of Viet Nam (NOIP) certification geographical indication "Tan Cuomg" for tea product since 2007. However, so far there are more inftinggment of rights to this geographical indication. This study aims to point out 3 acts inftinggment of rights to Tan Cuong geographical indication. The following acts shall be deemed to be inftingements of the right to protected geographical indications: Using protected geographical indications for products which do not satisfy the criteria of peculiar characteristic and quality of products bearing geographical indications; Using protected geographical ipdications for products similar to products bearing geographical indications for the purpose of taking advantage of their reputation and popularity; counterfeit geographical indications. The study results contribute to a theoretical and practical basis for the implementation of intellectual property rights to geographical indications, and help prevent inftingement of the rights to geographical indication Tan Cuong for tea product.
