Point d, Clause 2, Article 68 of the 2010 Law on Commercial Arbitration and Point d, Clause 2, Article 14 of the Resolution No. 01/2014/NQ-HDTP dated on March 20th, 2014 providing guidelines for the implementation of this Law has stated the base to cancel an arbitral award relating to the evidence provided by the parties that Arbitration Board based on to issue an award and the base to annul an award relating to the impartiality of arbitrators in arbitration proceedings which affect the objectivity and fairness of the arbitration award. This regulation seems to be "reasonable" but not really comprehensive. This article will focus on analyzing the provisions of current law on the two bases as mentioned above so as to point out some shortcomings of this as well as to offer the recommendation for the improvement of Vietnamese law on this issue.
