As a general rule, the owner has to bear the risk which occurs to the property. However, there is another provision that the subject who bears the risk which occurs to the property is not the owner. This article analyzes the Civil Code of 2005 and the Draft Civil Code (amended) on risks which occur to property, and puts forward the inadequacies and orientation to complete the provision on risks to property in Vietnam law.
