In modern society, the rights ofh omosexuals, bisexuals, and transgender (LGBT people) are attracting increasing attention and recognition. However, as in many other areas the rights of LGBT people in criminal justice are still neglected and eluded in multiple countries around the world. From the generalization of the rights of LGBT people under Vietnamese law, the article focuses on some theoretical and legal aspects of their human rights in criminal justice. The article identifies the holders elements, and basics to define the human rights of LGBT people in criminal justice, reviews the provisions related to these people, and introduces several recommendations for improving Vietnam s further legislations
