Quy định số 183/QĐ-TW quy định các biện pháp nhằm bảo vệ cơ quan, tổ chức, người thi hành công vụ trong hoạt động điều tra, truy tố, xét xử, thi hành án. Trong đó, để bảo vệ tính mạng, sức khoẻ cho chấp hành viên, vừa có những biện pháp đã có quy định ở các mức độ khác nhau ở các văn bản pháp luật hiện hành, vừa có những biện pháp mới được bổ sung. Để quy định sớm đi vào thực tiễn, trong bối cảnh Luật Thi hành án dân sự đang được sửa đổi. Bài viết phân tích, làm rõ mức độ thể hiện và tính phù hợp của các biện pháp này trong pháp luật hiện hành, liên hệ một số kinh nghiệm quốc tế, từ đó đưa ra một số kiến nghị cho pháp luật Việt Nam.
Regulation No. 183/QD-TW stipulates measures to protect agencies, organizations, and public servants in the investigation, prosecution, trial, and execution of judgments whe-rein to protect the life and health of the Enforcement Officer, some measures have been provided at different levels in current legislations, and several new measures have been added. To translate the Regulation into practice, in the context of amending the Law on Civil Judgment Enforcement, this article analyzes and clarifies the level of expression and appropriateness of these measures in current legal provisions, in reference to some international experiences, and thereby makes some recommendations for Vietnamese law.
