Heirs regardless the contents of a testament is always being considered when inheritance estate is distributed pursuant to will. However, provision about this issue at Article 669 of the Civil Code 2005 (Article 669 of the Fourth Draft of the Civil Code) are not unclear to be applied uniformly. In this essay, the author shows out shortcomings and suggests the way to amend this provision.
