The article analyzes the provisions of international law on maritime delimitation to point out: "special circumstances" (under the UNCLOS) and "relevant circumstances" (under international customary law) are synonyms. Special circumstances play an important role in the delimitation process, but the international law doesn't contain any provision defining or giving a list of these circumstances. State practice and international jurisprudence show that many circumstances have incidence on maritime delimitation. They can be divided into two groups: geographical and non geographical circumstances. The article concludes that for a maritime delimitation to be equitable, states may or may not take all special circumstances into account, provided that there is a consent between them.
