Bài viết này tập trung vào trách nhiệm giải trình của Nhà nước với tư cách là đại diện chủ sở hữu trong quá trình quản lý đất đai tại Việt Nam. Dựa trên các yêu cầu của việc xây dựng nhà nước pháp quyền xã hội chủ nghĩa và quyền sở hữu đất đai của toàn dân, bài viết chỉ ra những lỗ hổng trong luật pháp và rào cản trong quá trình thực hiện trách nhiệm giải trình trong lĩnh vực đất đai. Trên cơ sở đó, bài viết đề xuất các giải pháp cải thiện luật pháp để đảm bảo trách nhiệm giải trình của Nhà nước, thông qua các cơ quan liên quan, được giao quyền đại diện cho chủ sở hữu đất đai tại Việt Nam.

This article focuses on the State's accountability as an owner representative in the process of land management in Vietnam. Based on the requirements of building a socialist rule of law state and the people’s land ownership, the article points out the gaps in law and barriers in the process of exercising accountability in the field of land management. On that basis, the article proposes solutions to improve the law to ensure the accountability of the State, through the relevant agencies, that are assigned the right to represent the land owner in Vietnam.
