According to the law, the decisions of administrative punishment are administrative decisions therefore individuals and organizations that are sanctioned have the right to appeal this decision. However, the existing laws do not specify if decisions of implementation of administrative punishment are administrative decisions or judicial decisions. This leads to many difficulties in determining the relevant legal guarantees to protect the rights of persons who is subjected to these measures. This article analyses the content and nature of the decision on application of administrative measures and proposes solutions to complete the legislation to ensure the rights and legitimate interests of the person who is subjected to the measures.
