Tình trạng “nền kinh tế phi thị trường” mà hiện nay Hoa Kỳ đang áp dụng đối với Việt Nam đã trở thành một rào cản thương mại vô hình, gây ra những tác động bất lợi cho các doanh nghiệp xuất khẩu của Việt Nam trong các vụ kiện chống bán phá giá. Mục tiêu của bài viết này là phân tích quy chế nền kinh tế phi thị trường trong pháp luật chống bán phá giá của Hoa Kỳ; đánh giá tác động của quy chế này đối với hàng xuất khẩu của Việt Nam; và triển vọng Việt Nam được Hoa Kỳ công nhận là nền kinh tế thị trường.
The situation of the “non-market economy” that the US is currently applying to Vietnam has become an invisible trade barrier, causing adverse effects for Vietnamese exporters in anti-dumping lawsuits. The objective of this paper is to analyze non-market economy status in the US anti-dumping legislation; assessing the impact of this regulation on Vietnam’s exports and the prospect that Vietnam is recognized by the US as a market economy.
