Article No.6 of the Vienna Convention on Contracts for the International Sales of Goods 1980 (CISG) gives the rights to parties to exclude the application of this Convention. The question is whether or not the parties could express this exclusion implicitly in the contract. Article No.6 has no answer for this problem which leads to legal risks for the parties because the contract could be subject to another legal system conversing the parties' intention. After examining how the parties apply the Article 6 and analyzing judgments of courts and international arbitral tribunals, the research concludes that the parties are allowed to exclude CISG tacitly but this exclusion has to be clear.
